Bar Association: Public having doubts about Barbados lawyers’ credibility. (No Kidding!)

Leslie Haynes QC, the President of the Barbados Bar Association, is whining in the Nation about how tough it is to be a lawyer these days when the public over-reacts to a few bad apples.

Our message for Mr. Hayes:

Everyone understands a few bad apples in any profession – it is the Bar Association’s long and sordid history of excusing thefts, covering up for the “old boys’ network” and failing to protect the interests of citizens that has the public concerned.

Oh for sure, the Bar Association has lately paraded a few crooked lawyers in public or before the courts, but that’s nothing compared to decades of the Disciplinary Committee going easy on their fellow lawyers and even welcoming them back with open arms after a few months “suspension” – while the lives of their victims are destroyed.

Let’s review a few stories and then open up the discussion, shall we?

Story 1: Barbados Bar Association Condones Theft From Clients – And Destroys The Reputation Of Honest Bajan Lawyers

“It has now been clearly established that the Barbados Bar Association does not consider it a big deal for a lawyer to steal $130,000 as long as the lawyer returns the money when caught. According to the Disciplinary Committee of the Barbados Bar Association, a simple reprimand is a suitable penalty.

No disbarment. No criminal charges. No Jail.”

Story 2: Disciplinary Committee of the Barbados Bar Association prove they are as incompetent as the lawyer appearing before them

“Attorney Balfour Layne and all the big-name lawyers of Disciplinary Committee of the Barbados Bar Association didn’t know the law – which is pretty pathetic by any standard…”

Story 3: Crooked Barbados Lawyers Being Charged With Theft Mostly By Foreigners: Bajan Global Report

“According to our friend at BGR, it is mostly foreign nationals who are taking crooked Bajan lawyers to court. Is this an indication that crooked Bajan lawyers target mostly foreigners – or that foreigners are more likely to be respected and protected by the police and courts than domestic victims?”

Story 4: Crooked Barbados Lawyers: Only One Arrested, Many Others Allowed To Walk Free… Why?

“Folks were recently surprised to read in the Nation News that a crooked Barbados lawyer had actually been criminally charged with stealing from clients. Usually the Barbados Bar Association does everything it can to “handle” such situations internally. By processing complaints of theft through the so-called disciplinary committee, the lawyers make sure that their own kind don’t get hurt too badly…”

Story 5: Barbados Court of Appeal says Thief Lawyer Mortimer Clarke OK to practice law.

“True to form, the old boys’ network reluctantly imposed only a nine-month suspension on a Barbados lawyer who was caught stealing $150,000 of client’s money from his “trust” account. Just to put this in perspective, anywhere in the civilized world a lawyer could expect a year or two in jail and permanent disbarment for similar activities. Not so in Barbados where the legal profession is apparently happy to accept Mortimer Clarke back into its welcoming arms after he has a little vacation. (”Pity you had a client complain, Morty old chap. We’ll have to make a show of it for a few months. Hope you understand.”)…”

Surprise! Barbados Constitution to be amended today with zero notice, no debate by news media, public

DLP Thompson Government picks up where BLP left off – ignoring citizens’ right to know

Like the previous BLP Arthur/Mottley government, the current DLP government will be quietly sliding through various changes to our Constitution whenever it strikes their fancy. Appearing on the Order Paper today is the “Constitution (Amendment) (No. 2) Bill” that will somehow change the legal foundation upon which our country stands. Will this change impact your rights or obligations? Why is it being done? Will any group or persons receive a special advantage because of this amendment? Why is it necessary?

Perhaps you’ll find the answers in the Bajan news media, but usually you won’t.

As citizens we have a right to expect to be notified IN ADVANCE of ANY and all changes to our Constitution – no matter how “minor” the government says the changes are.

The Arthur/Mottley government must have changed the constitution a half dozen times or more with no notice: once even changing it to allow foreign military on Barbados soil and providing foreign military personnel with power and authority over the actions of citizens. That was during the Cricket World Cup and the government quietly slid it in with no notice and the full cooperation of David Thompson and his DLP.

You can read the bill here, but where is the Barbados news media on this? Where is the reporting, the investigative journalism, the probing questions?

Awwww…. forget it.

Successive Barbados Governments all talk as drunken road slaughter continues

The first job of government is to protect the citizens, and successive BLP and DLP governments have failed to protect the citizens when it comes to people who drink and drive.

Six dead at the Joes River tour bus crash, four more dead in the Emancipation Day crash and others. But in these and other serious crashes since, aside from an autopsy, Barbados Police have no way of proving how much an involved driver has been drinking.

That is because our government has been negligent in providing the legal structure and the equipment that the police need to protect us all.

The Barbados Labour Party had three terms and 14 years to deal with the slaughter on our roads and they did nothing. Barbados has no effective anti-drinking and driving laws. Short of a driver being falling down drunk, our police have no recourse because there are no laws to enforce. Even with a mass traffic death our police have no law to compel a driver to prove their sobriety, and no equipment even if such laws existed.

As Transport Minister in 2006, Gline Clarke talked about banning the use of cell phones while driving and of introducing breathalyzer laws and equipment. Mia Mottley and Dale Marshall both promised to introduce breathalyzer laws – but those promises were only words that came up every time we had a mass road death.

Nothing by shite talking, for sure.

As a matter of fact, let’s change the photos to reflect reality, shall we? Here is a photo of the three promising to do something about the road slaughter…

There. That’s a much truer picture of these three who pretended to care, who pretended to be doing something about the road slaughter. They are LIARS who promised breathalyser laws and hands-free cell phone laws for drivers. Check out their own BLP blog if you don’t believe us!

Now let’s look at the current bunch of do-nothings.

Minister of Public Works and Transport John Boyce has had almost two years to implement breathalyzer legislation and other needed changes to the road traffic regulations but has done nothing. Oh ya, in the weekend papers Boyce says he’s “talking” about changes with the police.

That’s nice.

That’s also what Mottley and Arthur and Clark and Marshall said once a year every year.

I guess it must be that time of year with the DLP government because they talked about these changes last year too.

Attorney General Freundel Stuart, Prime Minister David Thompson and Transport Minister John Boyce have blood on their hands and instead of action we see more of the same promises that we’ve been seeing from successive governments for two decades.

You can believe Stuart, Thompson and Boyce if you want to. I’d love to be proven wrong – but I don’t believe a word they say anymore.

That’s it folks. No further comment is needed about the government’s policies and actions concerning road safety, roads or traffic flow. The editors of the Barbados Advocate have looked into everything and declared “the government is doing all it can…”

Yup. That’s it right there. Might as well shut down the blogs, the competitive Nation newspaper and disband the Barbados Road Safety Association. The Barbados Advocate says the government has it all under control and “is doing all it can…”

Strangely absent from the editorial is any mention of the absence of modern drinking and driving laws in Barbados despite promises by successive DLP and BLP governments over the last 25 years. Also absent is any acknowledgment that we pay our police officers so little that we are one hundred officers under authorized strength. Very few quality people want to be a Barbados police officer and that shortage means that traffic enforcement is neglected.

The worst of it is that when a serious motor vehicle accident happens, our police officers lack the laws, technology and training to determine if alcohol played a factor. Barbados Free Press has been calling for breathaliser laws and equipment for the police for approaching four years now. In that time we have seen some horrible accidents and even mass fatal accidents – but our law enforcement officers still have no way of testing to see how much those drivers had been drinking. Short of falling down drunk, there is no law against drinking and driving in Barbados.

As we said almost a year ago when we criticised the Thompson DLP government for doing nothing about the slaughter on our roads…

Three Men Who Could Have Saved Lives But Chose Not To

Prime Minister David Thompson, Attorney General Freundel Stuart and Minister of Transportation John Boyce did nothing in the past nineteen months to introduce breathalyzer laws and equipment to Barbados, or to stop the drunken slaughter on our roads every weekend that kills outright or cripples people for life and destroys faces, families and livelihoods.

They have no reasonable excuse for not doing so.

Barbados Chief Justice Involved In Corporate Law Breaking – Documents Online!

Sir David’s Corporate Records Not A Pretty Sight

The folks over at Keltruth blog have been at it again — rummaging through the property and corporate records that are available to them in Barbados. They don’t always find all of the records, and we have a feeling that some records disappear at exactly the time they walk in the door, and then magically reappear when they leave the government office.

But they always seem to find enough records to piece together the most curious of stories every few weeks, and this week is no exception.

As a lifelong professional politician, Sir David Simmons at times served as Deputy Prime Minister of Barbados, Attorney General and Cabinet Minister in the Owen Arthur government. In private law practice Sir David represented many clients in large land deals and was himself involved in land speculation and business deals through various companies in which he had a stake.

After making his fortune and mastering the Art of the deal, Sir David decided to leave the rough-and-tumble of politics for the stately dignity of the post of Chief Justice of Barbados.

As Barbados Free Press extensively covered in the past, David Simmons had to reinvent himself [at least publicly] before taking the position of Chief Justice. Much like a girl whom too many men know too well, Sir David had to be reborn as a new virgin in search of a husband — or in this case, a respectable job.

He attempted to do this by resigning from politics and the government for a few months before then Prime Minister Owen Arthur [his good friend and drinking buddy] anointed him as one of the most powerful men in Barbados. Once freed from the backroom deals of politics, Sir David’s dignified place in Barbados history was assured…  Or so it seemed…

The only fly in the ointment are all those legal documents floating around Barbados that Sir David signed before he became Sir David!

Well, Keltruth Blog has rounded up some of those documents and it’s not a pretty sight. Apparently the Chief Justice recently testified that he resigned from one of his corporations in 1994. The only trouble is that no record of his resignation appears until 2007 when he was about to be exposed. And then there are other of Mr. Simmons’ corporations where no financial statements were filed for years — contrary to the law.

Barbados deserved a Chief Justice who could be seen to be independent of politics and political favoritism, but the good of the country came second to raw ambition and the consolidation of power.

It was unethical for Prime Minister Owen Arthur to appoint his Attorney General as our Chief Justice. It was unethical for David Simmons to accept the office of Chief Justice, but he wanted it so badly for himself that he was willing to undermine the independence of our judicial system and our courts.

Sir David Simmons wanted to appear as Chief Justice like a Virgin bride on her wedding day, but the corporate documents found at Keltruth are like an old boyfriend at the back of the church yelling, “Hey Hot Stuff, remember that night when?”

David at Barbados Underground has a problem. He surrendered his audience to “Black Woman Who Reads” and “her” supporters to allow the most vile of threats and racial attacks against people like Adrian Loveridge, the Knox family and others whose skin is not dark enough.

Now… the racists at Barbados Underground are faced with the embarrassment at the revelation that their racist attacks against whitey and Guyanese as led by BWWR were actually the work of a venomous old British white guy named Iain Deane who is a defendant in the Kingsland fraud trials. What a joke!

“Well, you know something, if it was not for old black women like me, wunnah would probably still be indentured. And because of my labour and sacrifice, I am not going to allow you to give our country away and bend the knee…” …old white guy Iain Deane as Barbados Underground’s prolific author “Black Woman Who Reads”

Mr. Deane had an agenda to support his side in a fraud trial so he created an “old black woman” persona and whipped up racial intolerance of the “whitish” old lady Madge Knox who is in the way of Mr. Deane’s ambitions. Deane called for black bajans to stalk the Knox family and other persons who are court witnesses against him in the Kingsland fraud trials.

David at Barbados Underground allowed and supported this racial venom whipped up by Iain Deane who claimed to be “Black Woman Who Reads” an old black cook at Kingsland finally taking sides against her white oppressors – the Knox family. The series of almost TWENTY major articles dominated Barbados Underground for almost a year and during that time blog owner David allowed Iain Deane and friends to rail on against whites, Guyanese and asians.

Here we are six days after the story about Iain Deane being “BWWR” broke at Keltruth Blog – but Barbados Underground has not said a word of explanation about the fact that their most prolific race-baiting author is really a washed-up old white guy who whipped up racial intolerance to suit his personal agenda.

What a joke!
