Both Affidavits can’t be true!

Some interesting reading from a recent court case [March 2015] in St Vincent where Dave Ames is no stranger to litigation.

In this case  on Page 4 the judge rules on the audacious delays by Ames in filing statements…

“Mr Commissiong deposes that Mr Ames lives in England and travels a lot globally making it difficult for him to be in Saint Vincent to testify. Implicit in Mr Commissiong’s averments is the notion that for those reasons, it was impossible or extremely difficult to contact Mr Ames, receive instructions from him, or arrange for him to sign a witness statement. I make the observation that the CPR permits a party to file and serve a witness summary if he is not able to provide a witness statement, and that a witness does not need to be in the jurisdiction to sign or attest either document.”

Now this is totally the opposite of what lawyers and Ames claimed last October 2014 (in the group of 33 investors failed case) when the judge was told that the company was NOT run from Essex. (See Judge rules against Harlequin investors in £1.8m court case)

“The case did not centre on whether or not the investors were owed money, a point which deputy judge Nicolas Strauss QC noted ‘does not appear to be in dispute’. Instead it focussed on whether a UK court could wind up Buccament Bay, given that the company was incorporated in Saint Vincent and the Grenadines.

While the investments were sold through Essex-based Harlequin Management Services (South East), which filed for administration in April 2013, Strauss ruled that Harlequin’s ventures including Buccament Bay were not run with ‘bird’s eye management from Essex’. He agreed that they were largely managed in Saint Vincent and the Grenadines and therefore this was the correct jurisdiction to apply for a winding up petition.”

The fact that Mr Commissiong’s claim that Ames couldn’t possibly find the time to be in St Vincent for the Stewart case makes a complete nonsense of Ames’ submission to the UK court that the Harlequin business was entirely run from the Caribbean and therefore the UK court’s jurisdiction does not apply.

Quite obviously both Affidavits cannot be true and both evade bringing Harlequin and Ames to account.

The 3rd Duke of Bridgewater and perhaps even Isambard Kingdom Brunel would turn in their graves if they could see how the Unity Labour Party have neglected our little island’s waterways and bridges to the extent that bridges are destroyed on a regular basis.

It’s ever so simple to comprehend really – streams, rivers and tributaries have to be kept clear of obstructions and siltation on a very regular basis. If this procedure is neglected even for one season,  flooding will ensue which will cause river bank and bridge damage, if not total loss of bridges. Everyone with half a brain knows that, but obviously not the ULP leadership.

Over the last fourteen years just about every bridge on our tiny island of Saint Vincent has suffered serious damage. The rivers are allowed to collect tree trunks and roots and other debris and rubbish without regular round the year maintenance and clearance by teams of work men clearing and burning such vegetation waste. When it rains heavy this debris floats down river and blocks under bridges.

Of course the silt level under bridges is allowed to grow to such an extent that between the debris and the silt, an effective dam is created.

When the silt and debris effectively blocks the water flow under the bridge the water builds up to an enormous pressure that damages the bridge and attached road. The sudden release of a large volume of water rushes down river taking with it the next bridge, if there is one, where the bridge dam sequence and sudden release is repeated on a magnified basis, also taking river banks on its way. Eventually this torrent overflows into the ancient flood plains as has happened for hundreds of thousands of years.  Continue reading

The numbers tell us one giant truth: From the start Harlequin was set up as nothing less than a Ponzi scheme requiring a constant influx of new victims to keep everything going.

Consider these numbers…

– Total “deposits” by victims: US$800 million

– Percentage of “deposits” paid as salary and sales commissions: 50%

– Percentage of “deposits” used to pay interest to earlier “investors”: 22% (estimated, see below)

– Number of units sold: 9,114

– Number of units built: 230

It might be worth Ames and his merry band of supporters considering to remain silent throughout 2015.

To do so would reduce if not eliminate the anti-Harlequin responses no matter how articulate and factual they may be, given that the anti-Harlequin posts in the main are merely responses to the incessant nauseating, repulsive litany of lies emanating from Harlequin and their supporters in their never ending quest to justify “at best” the gross incompetence and abject failure by the Ames family and staff of Harlequin to operate their businesses in a proper manner.

The constant need to allay the blame for the failures of the Ames family and management at Harlequin at the door step of others demonstrates that the Ames family and management of Harlequin are in serious trouble.

And that summary is giving Ames and his cohorts far more benefit of the doubt than the facts say they deserve. The only reason I can think of that they haven’t been arrested as yet is that the Serious Fraud Office has been overwhelmed by the planned worldwide chaotic nature of the fraud through only god knows how many different companies, coupled with legal contracts bearing so much fine print, inter-jurisdictional references and available outs for the criminals.

The resorts will most probably never get built, not in the lifetime of many of the purchasers victims.

Secret Harlequin Resort legal documents ‘found on London train’ – here they are!

Dear Barbados Free Press,

We were just coming of a train just outside London and we found a box of documents relating to “Due Diligence” of a company or companies called Harlequin, they appear to be developing resorts in the Caribbean so we feel this is probably a good place to show what we found, especially for anyone out there who might be interested in investing in Harlequin.

There are many files to upload so please bear with us.

This is a 70 page redacted interim intelligence report from Regulatory Legal Solicitors, it makes for pretty grim reading, we did not redact it, the documents are exactly as we found them on the train.

This is an interesting witness statement from Jim Baker contained in the due diligence documents apparently left on the train, by a guy who resembled Simon Terry, but it was dark so we could not be sure.

Seems to be a lot of people suing Dave and Carol Ames in the Courts in the UK, wonder why this was in the Due Diligence, Seems like Jim is saying that Harlequin are worth nothing.

Okay, okay… we’re a little behind on things. Might have had a couple of lost nights in the tradition of Dick Van Dyke. (Loved him in Mary Poppins, nevermind the worst phony cockney accent in film history!) The private housing development along the Buccament River, in fact beside the Buccament river in the flood plain, was going full speed when I visited last week. Express work is taking place on finishing about a dozen further units, with all stages in progress from start up on.

I walked with a family member of the land owners and builders, who told me the family is worried that they may be stopped from building. But he thought perhaps because of the relationship between them and the ULP leadership they had some considerable protection.

Considering the devastation caused by the December 2013 flooding it is unbelievable, perhaps even criminal, that the government has not stopped further building in an area which has been recorded as a disaster zone for centuries. The area is an ancient and modern floodplain, as shown by the follow records going back to 1876!  Continue reading

SVG High Court Registrar resigns suddenly – rumours flying about Harlequin connection

File this under “Breaking News… or Rumour?”

I-Witness News in St. Vincent and the Grenadines is reporting that the High Court Registrar (Tamara Marks) didn’t show up for work this morning (Friday 23 May 2014), and that she resigned.

BFP’s own source says it is rumour at the court that it has something to do with the Harlequin mess. Take that with a big chunk of sea salt, okay?

Registrar Tamara Marks is wife of former senator for the ruling Unity Labour Party, lawyer Ronald “Ronnie” Marks, who was himself arrested in 2013 in New York City for assaulting a police officer. Those charges were thrown out of court and Marks said he would sue the NYPD.

My anonymous ID is one of those referred to in the Harlequin subpoena, but I always used an anonymous proxy.

Nonetheless, I’d be lying if I said I wasn’t fighting off an overwhelming fear of the consequences of them discovering my identity. Not because of the defamation threat; I see no issues with me proving what I said was true. I just could not stand by and watch the shameful lies, deception, bullying and propaganda being spouted from Ames and his conspirators. They misuse the courts to shut down any public criticism because they cannot continue to defraud people when information is flowing freely.

Too many peoples’ lives have been damaged in the Caribbean and UK. Many lives have been irreconcilably ruined. And the UK authorities just stand by, knowing what is happening, and let it continue to happen.

Barbados Free Press on WordPress has been the only major website which has continuously stood up to threat of litigation and enabled the reporting of the true Harlequin story to appear on internet search results despite Harlequin’s scatter gun litigation attack on the rest of the internet.

BFP and WordPress must have saved hundreds and maybe thousands of people from being ripped off and has given those who want to keep the real facts out there and alive a mainstream social media channel to communicate through.

Dave Ames and Harlequin Property file legal papers against Barbados Free Press readers

Hi folks,

A few weeks ago we informed our readers that Harlequin had served our webhost WordPress – Automattic Inc with a court subpoena concerning reader comments on Barbados Free Press. Ames and Harlequin want to discover the identities of BFP readers who left anonymous comments on stories about them.

This will be difficult even if WordPress turns over the ip numbers to Harlequin because further steps are required with internet suppliers in other countries. Lots of folks use proxies and protection like ‘Anonymouse.org‘ for surfing too. Nope, we’re not worried at all and we run this here little blog. Have for nine years and the DLP and BLP haven’t found us yet!

WordPress didn’t send copies of the legal papers to us, so we presume they are fighting it out in court with Harlequin and David Ames. WordPress inventor Matt Mullenweg has a reputation as a hell of a scrapper when it comes to defending free speech and he’ll spend millions rather than give into extortion. (Matt is the handsome young chap above, just turned 30. And ladies, not only is he single – his business costs about $400,000 a month to run, but takes in gross revenues of $45 million a year. You do the math. The latest Business Insider issue says Matt is probably worth a billion yankee dollars and he has homes in New York, California and Texas. He was in Barbados a few months ago – I’ll try and find the photos I saw on the web.) 

Today we received more legal papers – unofficially and anonymously – from someone. This batch lists exactly what comments and BFP readers that Ames and Harlequin is after.

We’re not worried because we know that the WordPress business model would collapse overnight if Matt and the boys didn’t defend free speech.

Besides – we believe in Matt and WP crew. They will fight this attack all the way on a purely ideological basis – nevermind anything else.

Whilst researching the Christmas Buccament floods I discovered that both Ralph Gonsalves and Julian Francis as government ministers were both informed as early as 2001 that Buccament was likely to flood. They were instructed to carry out urgent river defenses but almost every year for about 13 years just got more and more reports on the matter. They had the reports done because the World Bank was paying for the reports, they cost us nothing. But after getting the reports they failed to act – and that failure to act proved to be fatal  for a number of people.

In some of the reports it is even quoted that Buccament is in a flood plain. As such they allowed new building in a flood plain next to a river that was almost certainly going to flood, and it did.

Remember the videos of Gonsalves walking through Buccament with tears in his eyes? Was that all an act? He must of been terrified that the people would find out that he was pre-warned and failed to act, thus being a direct contributor to the loss of all those poor people.

The piece below is something I have submitted to all the newspapers and online publications. We will have see if the SVG newspapers have the courage to publish what I have written, regardless of the fact that its all verifiable as the truth.

Buccament Bay flood deaths neglect, dereliction of duty or something worse?

On December 24 and 25, 2013, Saint Vincent & the Grenadines was hit by a low-level, high-impact trough system which caused severe infrastructure damage to the country. The trough brought high winds, torrential rains and floods. Local rainfall stations reported between 200mm and 310mm on the windward side of the island and 153.3mm in the leeward side of the island.

As a result of the disaster event, there were 11 confirmed deaths and 3 persons were never found. The final disaster assessment concluded: 77 homes were completely destroyed or severely damaged; approximately another 300 homes were damaged; and 500 people were displaced and housed in temporary shelters.

Since their first year in power there is unequivocal evidence that the Unity Labour Party [ULP] government have been fully aware of the vulnerability to serious flooding at Buccament and in other places. They were aware that Buccament is generally a flood plain area.  Their studies from 2001 to 2014 show just that. They have had thirteen years to put river defenses in at Buccament, but failed to do so. The Christmas 2013 Buccament flood tragedy occurred and lives were lost.

For thirteen years the government had dragged their feet and carried out numerous studies for Social Assessment Disaster Vulnerability Reduction Projects, at Buccament and elsewhere.

We were a little low in our previous estimates as it turns out that Matthew Ames defrauded investors of £1.6 million, some £400,000 more than thought – but hey, what’s a few pennies between friends?

The son of Harlequin’s Dave Ames was sentenced to 40 months in jail, which seems a short sentence considering that many of his victims are sentenced to life in poverty and despair.

It took about 3 years to bring Matthew Ames to justice, but that is quick considering the ongoing disaster of Harlequin Resorts created by Dave Ames and other ne’rdowells.

How often does a ‘Hundred Year Event’ happen?

According to Harlequin’s Solicitors, it only happens once in a hundred years.

They said that the World Bank are sending a report in which Christmas floods will be described as a hundred year flood.

Obviously Harlequin do not know what a ‘100 year flood’ actually means.

We need to be aware of a 1 in 100 year event does not mean the probabilities will only happen once in every hundred years. It actually means that it is an event that will happen once in every 100 big cloud bursts or storms. If you had a hundred of those in a day, there are probabilities that such flooding will occur. If it happens in a week, then once a week, if it happens in a year once a year etc. In fact what it means there is a 1% probability of it happening. See here.

There is approximately a 63.4% chance of one or more 100-year floods occurring in any 100-year period.

That means folks, 63 floods in a hundred years, more than one every two years.

Over three years ago on this very website, BFP reader Gorillaphant declared what any fool could see for hisself: Buccament Bay Resort is built on a flood plain between two mountains, so close to the sea and sea level that death and disaster was bound to come.

Buccament Bay Resort was built on a known flood plane and areas that were known as swamp. Flooding of this area has been happening since the very beginning of the valley, which acts like a great funnel draining into the bay itself.

Everyone knew that, certainly the locals and most certainly the planners and government surveyors knew that.

The resort area had the richest soil of the whole island, silt carried there from present day and over millions of years. The farmers that farmed the area were used to seasonal flooding, their crops grown in the ultra fertile soil were the best produce money could buy.

Then along came a series of rich developers and they were driven from their land. Most of the farmers had purchased the land from the government. But that didn’t matter, the prime minister sought to regain the land and to sell it to developers. The farmers initially refused to give up such wonderful agricultural land, fully well knowing they would never find anything like it anywhere else on the island. Prime Minister Gonsalves took to shaming them into parting with their land by telling them they were standing in the way of progress of the island, by progress he meant destroying their farming practices and replacing them with a tourist product.

It was becoming obvious that agriculture was becoming less and less important to the ULP government, who considered tourism their crowning glory as an administration.
