Son of ADR: Solving the court case backlog by throwing out unresolved cases. THIS is a solution?

Dear Barbados Free Press,

Regarding the recent “pronouncements” from on high, inter alia: how to use Alternative Dispute Resolution  – ADR – to clean-up the back-log, and more lately “Son of ADR”: how to forcibly “throw-out” or “discontinue” all the most embarrassing old cases…

Wait a minute! Better is to come: to get a feel as to whether these are good ideas, the boss is asking the Bar Association.

What’s their take on it? No, we don’t wish to ask all those plaintiffs who have paid their attorney’s fees already how THEY feel, (maybe, several payments). We’re now about to ask the same guys who – on many instances, wrap the whole process up in sticky tape thereby contributing to the legal arthlesclerosis which now threatens a key  pillar of our constitution!

Judging (sorry the pun) from the above correspondence, the boss was about to lay down the law (sorry etc), but the latest attempts to cut the gordian knot of this systemic mess of legal ineptitude, seems to indicate that the boss is running up the white flag! Whaddawedo next? Get a new boss?”

    All the cases dealing with land need to go out the door, Most or all dealing with land have no root title. Fraud is the case and the lawyer may know or cant find the Plantation deeds for both sides are not the owners. lawyers will go broke for they have no stolen deeds or land to sell. Title search will show broken deeds lines.No clear titles.
    Violet Beckles and Beatrice Henry land now handed down to her Heirs.
    On the plane people telling us how the land tax numbers now showing up in name they dont know , For they were the persons who rented the land and then died? Land tax Mr Ford will have to come clean with his Massive Fraud and not wanting to talk to the true owners to fix it.     Man BFP give us the whole truth for a change nuh?
    “As a result, he(Gibson) said that a backlog reduction and individual assignment committee had been established- chaired by Justice Maureen Crane-Scott-to reduce the backlog and deepen “the system of one case one Judge”. “It is planned that the court will send out notices to attorneys and litigants with regard to cases filed between January 1990 and October 2009 with the possibility that if no response is forthcoming, or if the attorney or litigant so indicates, that the matter will be dismissed or can be discontinued”. Gibson said.”
    That is not the same thing as your headline.
    As hard as it may be for BFP at least give Jack his Jacket. Misleading the public is in no one’s interest.

    Is this for real?. I thought that the Chief Justice would recommend putting a mechanism in place to deal with the backlog. Are we saying that justice can now be rationed, or thrown away like a bag full of sploit fruit, to make way for new ones? Are we not interested in justice for all? Due process for all? No night court, extended hours, change policy to mitigate stalling tactics by lawyers, nothing? but this silliness of throwing out unresolved cases?

    But some thought it would be so easy….now they are finding out.

    Why not check the ‘case turnover’ aka how many new cases are being done and how long they take.

    By 2015 what will be the backlog? Horse run loose and gone.

    Cant do a ting.

    Though from my distanced perspective the CJ is far from proving himself other than a rather smart media manipulator, thanks for setting the record straight on this one.

    Thank God someone in the centre of things (Mottley) has had the guts to speak out in Court about the misuse of the Bail Act. It’s time the Court of Appeal issued some very clear guidelines for our magistrates on this. They are not supposed to be paid prosecution hacks.
