A Sad Day For The Dignity Of The Office Of The Chief Justice Of Barbados

Barbados Chief Justice Sir David Simmons recently gave testimony for a Canadian court in the Kingsland land fraud case. The court transcript has been posted online at Keltruth Blog here so there is really no dispute about what Sir David said while under oath.

Sir David confirmed that in 2004 he ordered the destruction of his land speculation company’s business records  — even though the business records were evidence in an ongoing lawsuit concerning US$1 billion worth of prime Barbados real estate known as Kingsland. Disgusting, but true.

According to Keltruth Blog, the Chief Justice and some other defendants were recently dropped from the Canadian lawsuit about Kingsland. We at Barbados Free Press have to wonder if the charges being dropped against Sir David had anything to do with the unavailability of evidence that he ordered destroyed. If so, it can be seen that our Chief Justice is a very intelligent man — in a cunning sort of way.

Whether cunningly destroying evidence is a quality that we want to see in our Chief Justice is, of course, another matter.

Once again the people of Barbados are reminded what a mistake it was when then Prime Minister Owen Arthur appointed his former Attorney General and good friend as the Chief Justice of Barbados. Our country needed and deserved to have an independent, non-political person as its Chief Justice. Instead, Owen Arthur and the BLP decided to consolidate power by politicizing the office of our highest judge.

David Simmons was a career politician who had served as Attorney General and acting Prime Minister. He was also an entrepreneur, land speculator and backroom deal maker. As we have stated in the past, we believe that David Simmons should not have accepted the office of cheap justice Chief Justice, but that he wanted the job and the power more than he loved our Barbadian democracy and judicial system. He cheapened the office of the Chief Justice and made it impossible for citizens to have confidence that the highest court in the land was not a political tool. We shall never forgive David Simmons for allowing this to happen.

    You are correct about the purpose of Owen Arthur appointing his AG as Chief justice. In effect it made the courts another arm of the government. At least Thompson hasn’t dumped Simmons and put his own man in, but he probably will someday.

    Your statements against the Chief Justice are very venomous but I agree that David Simmons as a former AG and Minister of Foreign Affairs was the wrong person to appoint as CJ.

    if you read several articles back in the Keltruth blog you will see that according to the Barbados Government web site and the constitution set out therein, Simmons is unlawfully holding office and should have retired. Of course when you make up the rules and laws to suit your own purpose, the Rule of Law has become a joke.

    Thompson really has no alternative but to ask his good friend to step down.

    Is it venomous to ask why a lawyer and Chief Justice, no less, would burn files in the face of a Canadian action that inevitably would ask for those documents and files?

    This whole issue relates to transparency and full disclosure, something neither party wants to implement in Barbados.

    Disclaimer: I did not read the BFP article regarding the CJ. However, the day Owen S. Arthur (OSA) appointed David Simmonds as CJ he set an unparalleled president that essentially said that transparency can be set aside and we were entering a new and dangerous era as far as the appointment of CJ was concerned. As a result all other PMs coming after Arthur could do what they like and “get away with murder” when it comes to appointing further CJs. Ultimately the integrity of our judiciary has been permanently and irreparably compromised by the reckless action of OSA. I personally think that this more than any other action by OSA must be recorded as the lowest point in his undulating leadership. What is even more worrying is speculating who is the likely replacement for David Simmonds especially if Thompson, like OSA, decides to throw caution to the wind – at this rate don’t be surprised if we end up with a St. Christopher boy who currently spends hours on his computer (words removed by BFP editor Auntie Moses – SHAME ON YOU). If this ever happens we would have moved from the frying pan right into the fire.

    He is usually dead on but unfortuneately has no self imposed filters, fact or no fact. Personal attacks or smears that don’t deal with issues really detracts from driving fundamental change that is needed.
