If Greenland Proponents Do Not Charge Professor Machel With Criminal Libel or Obtain a Public Apology and Settlement, They Will Be The Laughing-Stock Of Barbados

In 2006 and 2007, University of Alberta Professor Hans G Machel published three major articles at Barbados Free Press dealing with his engineering and environmental objections to the Barbados Greenland Dump. In these articles, Professor Machel used language and terms against four proponents of the dump which surely violate the criminal libel laws of Barbados.

Don’t forget friends – Barbados is a country where newspapers and radio stations cower in fear of the libel laws and regularly pay out tens of thousands of dollars for the smallest mistake. As an example, in October of 2007 Voice of Barbados radio paid off Tourism Minister Noel Lynch to the tune of $60,000 when Lynch ran out of the studio after being asked on air to comment about his personal wealth and Integrity Legislation. So when Professor Machel in Barbados called out named people as being “stupid”, “incompetent”, “unqualified”, “a notorious liar”, “immoral”, “unethical”, “coward”, “totally untrustworthy”, “(full of) professional envy” and all the rest, it is serious business under Barbados law. I don’t know how things are in Canada, but in Barbados Machel could actually be arrested for such public statements.

As a matter of fact, IF Professor Machel is NOT charged with criminal libel when he can easily be found in Barbados at his speaking engagement on Wednesday night, the Barbados public will find that very noteworthy. IF Solid Waste Manager Ricardo Marshall, former Environment Minister Liz Thompson, former Health Minister Jerome Walcott and former Chief Geologist Leslie Barker DO NOT file charges against Professor Machel or obtain a public apology and settlement, they will be seen as the laughing-stock of Barbados.

Outsiders like Machel probably have no idea of the cultural importance of such a public slap in the face in Barbados.

But all is not so simple! If Professor Machel is charged with libel, the eyes of the world will turn towards Barbados. Folks in Washington, Zurich and London might start to look closer at what Barbados did with the tens of millions of dollars from the InterAmerican Development Bank that was supposed to be used to develop the Greenland Dump. Where is did all the money go? Who knows!

Nope, the BLP and the DLP have a bit of a dilemma on their hands. They can’t afford to have Professor Machel charged with his public statements, yet his words are so against Barbados culture and law that the failure to charge or obtain a public apology and cash settlement from Machel is political and career suicide. Outsiders just don’t understand how these laws are used to keep the people quiet in Barbados and how seriously these public insults are taken.

Professor Machel will be lecturing in Barbados on Wednesday, January 14, 2009 at 7pm at Solidarity House – where the Barbados Museum & Historical Society is sponsoring his talk on the Caves of Barbados – Dangers Underground (link to more info on his lecture). As a matter of fact, Professor Machel will be talking about the about the Codrington family who died when their home fell into a collapsed cave on Sunday, August 26, 2007.

And seeing as how there has never been an inquest into the deaths of a whole family, and there probably never will be an inquest held, Professor Machel’s talk will be the only discussion and presentation to date where the public can hear what an expert has to say about what happened to the Codringtons and whether it could happen again.

Who knows what nasty things Professor Machel will say about BLP Barbados government this time!

So Liz, Ricardo, Jerome and Leslie, whatcha gonna do? You LAUGHING STOCKS OF BARBADOS.

  4. Can you be arrested for libel? I do not think it is a criminal offense, but a civil one. I think you would be sued, not arrested.

    Interesting observation, but i don’t think anything will come of it.
    1: There is a difference between a libel threat, and suing someone for defamation, which is the only course of action under Barbados Law

    2: Defamation only occurs when the truth cannot be substantiated. This presents a great risk, to any of the assumed defendents, in particular the politico’s.

    3: To file a Law suite base on comments made on BFP would give a legitimacy to the blogs that many of the elites in Barbados have sworn not to let occur.

    4: A complainant does not have to wait until a potential defendant in a future law suite is in Jurisdiction. However to send a strong message the complainants Lawyer can stage the delivery of the writ to occur during the speech for maximum affect. Think about the times that Thompy got served during an election campaign meeting night while delivering a speech.

    Juris we need you to comment on the above because I don’t believe you can be arrested and charged for calling people names.

    Note that in Canada he would be sued for libel.

    That is one serious stretch, BFP where did you buy all of that elastic from?
    In any event, for two of those mentioned, being seen as the laughing-stock would be better than what they are currently seen as by many bajans.

    Politicians and bureaucrats don’t like it when they can’t control the message but between the concept of free speech and the fact that Machel was speaking the truth, it would be very stupid for any of these individuals to try and do anything. Then again Machel did call some of them stupid.

    I trust Professor Machel will have some heavy weights to usher him around.

    Hants, Liability, the Criminal Libel Act was repealed by the Defamation Act 1996, twelve years ago. Even though criminal libel still exists in Barbados, there are defences to it (comment being one) and contrary to BFP’s assertion it is not an arrestable offence.

    No way that anyone will take Prof Machel to task for what he said because everything he said is the truth.

    No way that Barbados or any of these people like Elizabeth Thompson want a close examination of the Greenland folly.

    My prediction is that Prof. Machel will not be touched and that proves everything he said is true.

    Had not previously read Prof. Hans Machel trenchantly argued and damming dismissal of the incompetents, and tenth raters that we Bajans have had the cruel misfortune to be saddled with, Liz Thompson, Jerome Walcott, Leslie Barker, Ricardo Marshall.
    It reinforces the horror story of the past fourteen years of the venal, corrupt, money grubbing slime bag regime of Liz Thompson/Owen Arthur/Billie Miller that decent Bajans had mistakenly trekked out to the polls and given their vote to for the past three elections before January last. A naive belief that the democratic practice of making an x on a ballot paper provides decent administration, openness, honesty and tranparent governance must seem like so much bitter ashes in the mouths of many Bajans today.
    As for the one year old virginal David Thompson government it very early begun to exhibit all the mores of a ten cent Nelson Street whore. Mininimal change, of style maybe, but of no significant substance. Broken promises, a lack of will to investigate and jail the bag carriers and wrongdoers of the past government. We appear to have a Prime Minister behaving increasingly like a little black yard boy for CLICO plc and by inference will go on bended knees to bow and scrape and brown nose corporate Barbados. It makes for an unedifying sight and shames us all.
    In contrast to our dimwitted and do nothing Prime Minister and his intellectually shallow cabinet we have increasingly seen a small number of white Bajans making a stand and are prepared to do battle on behalf of our heritage and future generations. Be it the obscenity and horrendous waste at Greenland, making sense of our tourism industry or the caretaking of our fragile environment. Here one speaks of Richard Goddard, Lowdown Hoad, and Adrian Loveridge (adopted). Respect is very much due to them.

    A person can only refer to another person in deregotary terms if theey have proven the incompentence and inability of that individual relative to something specific. In this case, the professor has enough justification to imply that the persons so mentioned exhibited behaviour that contravene proper discretion and character. And behaviour that was out of sync and out of touch with sound reasoning. Hahaha sounds to me like the BLP

I have known Richard GODDARD for over 50 years and know him to be an honorable and thoroughly fearless man with the best interests of Barbados at heart. He is a true son and patriot of Barbados.
